digital-DNA observes the following principles of behavior regarding information privacy. Each principle is stated below, along with links to more detailed explanations.
Principle of Openness: We practice openness in explaining who we are and how we use information we receive. Whenever we request personally identifiable information (e.g. name, address and other data that identifies an individual), we clearly disclose what details are required and how your ability to participate in our services will be impacted if you choose not to provide such information.
Principle of Accuracy: To ensure the accuracy of digital-DNA records, we will contact you periodically to confirm the information we receive. You can also contact us to review, amend or correct such information.
Principle of Collection: We limit collection of information to only those details we need for the stated purpose(s). We do not collect personally identifiable information (e.g. name, address and other data that identifies an individual) unless you provide it to us via our Web site, an e-mail message, a phone call or by postal mail. Because you must be 18 years of age or older to register for participation in survey projects through our Web site, we never target or knowingly collect personally identifiable information directly from children. If we would like the opinions of children who are under age 18 in your household, we will explicitly address the survey to the adult registered panel member and ask him/her to supervise the questions to be asked of the child.
Principles of Use, Disclosure and Retention: We limit use, disclosure and retention of the information contained in digital-DNA records. Under no circumstances will we ever disclose personally identifiable information, except when: 1) we need to secure behavioral data from clients to compare with survey responses; 2) we believe in good faith that the law requires it; 3) we are conducting business with our worldwide offices, subsidiaries and affiliates; or 4) we must protect the rights and property of digital-DNA. At any time, you may opt-out from receiving survey project notifications.
Principle of Secondary Usage: digital-DNA strictly limits secondary usage of personally identifiable information provided to us. In addition to identifying survey projects based on personally identifiable information, digital-DNA uses data from our members in statistical modeling to better understand trends among the general population.
Principle of Security: We employ a series of security procedures to protect the information provided to us.
Principle of Compliance: We continually review all aspects of our operations to ensure compliance with our stated privacy policy.

Through our network of offices and affiliations across the globe, digital-DNA's primary activity is the design, execution, and interpretation of market research conducted on behalf of clients, which include a majority of the largest 100 multinational consumer products and services companies. In order for us to determine which survey opportunities are appropriate for you and your household, we request some personally identifiable information (e.g. name, address and other data that identifies an individual). ACCURACY
To ensure we are providing survey projects that match your and your household's habits, interests and preferences, we will contact you periodically to confirm the information provided to us. Even though you are not able to opt-out of receiving these e-mails, you may decline to respond to this email or choose to be removed from our panel.Should your e-mail address change, please send a message to admin@digital-DNA.us.com. Please include your membership ID along with your old and new e-mail information. COLLECTION
digital-DNA limits the information we collect for our records to those details we need for the stated purpose(s). We will always disclose what details are required and how your ability to participate in our services will be impacted if you choose not to provide certain information. To complete your registration, we need your name, geographic location and various other types of personally identifiable information. When you respond to survey project notifications, we may ask for additional personally identifiable information to ensure a particular project is appropriate for you and your household's habits, interests and preferences. This information will be aggregated with other survey respondents.You can browse our Web site without entering any personally identifiable information and therefore remain anonymous during your visit. However, we hope all of our visitors will register with us so we can make their opinions known.
In order to participate in surveys or receive product trials, however, registration for the panel is required.
Children's Data
You must be 18 years of age or older to register for participation in survey projects through our Web site. When you register, we ask you to provide information on all members of your household, including children, for classification and survey qualification purposes only. However, we never target or knowingly collect personally identifiable information (e.g. name, address or other data that identifies the individual) directly from children. If we would like the opinions of children who are under age 18 in your household, we will explicitly address the survey to the adult registered panel member and ask him/her to supervise the questions to be asked of the child. The way in which the opinions of children will be used will always be stated explicitly at the same time the question is asked and we will not require a child to disclose more information than is reasonably necessary to participate in an activity. Usage Tracking
In order to ensure our Web site is as useful as possible, digital-DNA may retain details concerning visits to the Web site but will NOT compile these details with personally identifiable information. The purpose of such activity is to collect details about all users activities so we can track the number of visits to our site, how many times each page is accessed, the paths visitors take to access various pages and other usage details.Whenever you provide your household ID for a survey project, our servers document each session's log-in, pages visited and log-out. Each time you access the Internet, your computer is automatically assigned an IP address by your ISP (Internet Service Provider) or network. When you visit pages on the digital-DNA web site, our servers record your IP address in a log. These logs are then used for system administration (such as site usage reporting and analysis) so we can constantly improve the content we provide. For instance, if our tracking indicates numerous members are accessing a particular page, we will post a special link that makes it as easy to find as possible. We will not associate IP addresses with personally identifiable information unless our system administrators believe it is necessary to do so for recognizing visitors who threaten our site, registrants, customers or others.
Cookies
At this time, digital-DNA employs "cookies" (messages stored in text files on your hard drive containing details about your visits to our web site) for the purpose of tracking particular survey sessions, and they are made inactive when surveys are completed. digital-DNA does not link the information stored in cookies to any personally identifiable information you submit while you are on our site. If there is ever an occasion, however, to expand the use of this technology, we will first ask for your complete consent to do so and explain the intended use of the information gathered.Links to Other Sites
The digital-DNA web site provides links to other World Wide Web pages that provide additional opportunities and information from third parties. digital-DNA’s privacy policy cannot and does not apply to external Web areas. We enable members to Tell-A-Friend about participating in digital-DNA surveys. If you choose to use our referral service to tell a friend about our site, we will ask you for your friend's name and email address. We will automatically send your friend a one-time email inviting him or her to visit the site. digital-DNA stores this information for the sole purpose of sending this one-time email and tracking the success of our referral program. After you register with digital-DNA, we will use the information you provide to determine which specific surveys you and your household qualify for, based on demographics and indicated interests, and contact you for participation, send product samples tailored to your habits, interests and preferences; or award and publicize contest and sweepstakes prizes. Winners are identified on our Web site by first name, last name initial, city and state only. In addition, digital-DNA collects members' survey responses (referred to as syndicated data) to design additional survey opportunities, but this process does not involve the disclosure of any personally identifiable information.LIMIT DISCLOSURE
digital-DNA releases registrants general demographic information, but this does not involve identifying any individual survey participant. We will not disclose any personally identifiable information (e.g. name, address and other data that identifies you) to business partners or third parties unless you agree, in advance, that we may do so, or for one of the reasons explained below: It may occasionally be necessary for digital-DNA to provide survey participants names and addresses to clients for single-use matching purposes to compare actual behaviors with survey responses. The matching is performed by digital-DNA after clients provide behavioral data for survey participants. When these completed survey reports are presented to clients, participants names and addresses are not included with the results. Clients that receive survey participants names and addresses are required to sign an agreement stating that the information will not be retained, copied or utilized in any manner other than identifying product or service usage history for the single-use matching purpose. These procedures strictly adhere to the Code of Standards and Ethics for Survey Research established by CASRO. In the course of operations to conduct market research surveys, digital-DNA may share member's information with our various worldwide offices, subsidiaries and affiliates. The recipients of this information are bound by the same use and disclosure terms as stated in this policy. digital-DNA may disclose personally identifiable information when we believe in good faith that disclosure is necessary to identify, contact or bring legal action against someone who is infringing or misappropriating digital-DNA's legal rights, or injuring or interfering with the property of digital-DNA or third parties (other individuals, organizations or businesses). SECONDARY USAGE
Whenever digital-DNA requests personally identifiable information, we will state the reasons for doing so. For example, we need to know geographic location, ages and other details in order to identify appropriate surveys for which you and your household will later be invited to participate.In addition to identifying survey projects you may qualify for, digital-DNA uses data from our members in statistical modeling to better understand trends among the general population. This statistical modeling helps companies identify the types of consumers who may be interested in products and services. When we perform this statistical modeling, we never release names or other personally identifiable information. Also, you or your household will not be targeted or contacted for marketing purposes as a result of this process.
Should digital-DNA have a need to use personally identifiable information for another purpose than those stated here, we will request your permission before doing so.
SECURITY
digital-DNA employs stringent security protocols to protect all facets of electronic and paper-based data collection, transmission, distribution and storage. To protect information from unauthorized internal or external access, we require a unique email address to authenticate anyone submitting, reviewing or working with information in our databases store member's personally identifiable information on separate servers from survey response data utilize firewalls to protect servers maintain audit records of log-ins, file accesses and other security incidents and employ a series of pass coded building security systems.Our Chief Security Officer and staff review security protocols on a monthly basis to ensure the systems integrity. In the future, digital-DNA will incorporate new technologies as they evolve to ensure the highest level of protection at all times.
COMPLIANCE AND ACCOUNTABILITY
Access to all data collected by digital-DNA is limited to the internal Chief Privacy Officer and those staff members designated by him/her who manage surveys or maintain the digital-DNA web site. digital-DNA staff members receive training on this privacy policy and our general information practices. Each staff person who requires access to system data must sign a confidentiality agreement yearly, as contained in digital-DNA's human resources policy.CONTACT

digital-DNA Panels Terms and Conditions
Each Panelist is responsible for maintaining the confidentiality of the username and password provided during the registration process. Such username and password should not be shared with any third parties. Each Panelist is responsible for all usage or activity on his or her account, including all costs associated therewith, whether or not the usage is authorized by the Panelist or the result of the Panelist authorizing a third party to use the Panelist's username and password.
Each Panelist is solely responsible for all taxes associated with redemption of points and payments received hereunder. digital-DNA reserves the right to require each Panelist to provide written consent on this provision.
Status of Relationship
Panelist and digital-DNA are independent contractors. Panelist shall not be considered an employee, agent or partner of digital-DNA.DISCLAIMER OF WARRANTY / LIMITATION ON LIABILITY
digital-DNA will not be responsible or liable for any injury, loss, claim, damage, or any special, exemplary, punitive, indirect, incidental or consequential damages of any kind (including without limitation lost profits or lost savings), whether based in contract, tort, strict liability or otherwise, that arises out of or is in any way connected with (a) any use or misuse of the Program, (b) any failure or delay by digital-DNA, its officers, directors, agents or employees in connection with the Program (including without limitation the use of or inability to use any component of the Program), or (c) the performance or non performance by digital-DNA, its officers, directors, agents or employees (including but not limited to any failure, delay or error in crediting points to the member account), even if digital-DNA has been advised of the possibility of damages. This disclaimer of liability applies to any damages or injury caused by any failure of performance, error, omission, interruption, deletion, defect, delay in operation or transmission, computer virus, communication line failure, theft or destruction or unauthorized access to, alteration of, or use of record, whether for breach of contract, negligence, or under any other cause of action. If, despite the limitation above, digital-DNA is found liable for any loss or damage which arises out of or is in any way connected with any of the occurrences described in the limitation above, then its liability will in no event exceed, in total, the sum of US $25.00. Some states do not allow the limitation of liability, so the limitations above may not apply to the Panelist. The digital-DNA Rewards Program is offered "as is" and "as available."
digital-DNA assumes no liability for lost or misdirected entry forms, registration forms or survey submissions whether due to technical or computer malfunctions or otherwise. digital-DNA assumes no liability for technical or computer malfunctions of any kind. If, for any reason, the Program is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the reasonable control of digital-DNA which corrupt or affect the administration, security, fairness, integrity or proper conduct of the Program, Sponsor reserves the right at its sole discretion to cancel, terminate, modify or suspend the Program.
Miscellaneous
digital-DNA's interpretation or application of the Terms and Conditions of the Program shall be binding on all Panelists. By enrolling in the Program, you agree to be bound by the full Terms and Conditions stated herein. You also agree to review these Terms and Conditions periodically and shall be bound by any modifications. If you do not accept these Terms and Conditions, or any subsequent modifications, your sole and exclusive remedy is to terminate your membership in the program. These Terms and Conditions make up the entire agreement between digital-DNA and you regarding the Program and supersede any prior agreements (whether oral or written). If a court holds any of these Terms and Conditions unenforceable, the remainder of the Terms and Conditions shall nevertheless remain enforceable. The failure by digital-DNA to act on any breach of the Terms and Conditions by a Panelist shall not constitute a waiver of digital-DNA's right to act with respect to any future breaches.Governing Law
These Terms and Conditions shall be construed in accordance with, and governed by, the laws of the state of California applicable to contracts entered into by California residents and to be performed within such State without regard to its conflict of law provisions. Any litigation to enforce or interpret the provisions of these Terms and Conditions or the parties' rights or obligations arising out of these Terms and Conditions or in connection with the Program shall be maintained only in the courts in Napa County, California and the parties expressly consent to personal jurisdiction in such courts.NOTE
This policy is effective as of January 1, 2007.digital-DNA reserves the right to transfer personally identifiable information to a buyer in connection with a sale of stock or assets, merger or any other transaction resulting in a change of control of digital-DNA. Of course, that buyer will have to honor the promises of privacy that we have made to you. You will have an opportunity to opt-out of such a transfer prior to the sale, merger, or change in control of digital-DNA.
If we are going to use your personally identifiable information in a manner different from that stated at the time of collection we will notify you via e-mail. You will have a choice as to whether or not we use your information in this different manner. In addition, if we make any material changes in our privacy practices that do not affect user information already stored in our database, we will post a prominent notice on our web site notifying users of the change. In some cases where we post the notice we will also e-mail users, who have opted to receive communications from us, notifying them of the changes in our privacy practices. digital-DNA reserves the right to change this privacy policy at any time.
Having read the Privacy Policy of digital-DNA, Inc., I understand how digital-DNA collects, processes and uses the personal data that I submitted on digital-DNA's website or that is automatically collected when I visit the website (including the compilation of use profiles) and that digital-DNA for these purposes may also transfer my data to the parent company Buchanan Group.
By ticking the box below and by submitting the information, I consent to my personal data being collected, processed and/or used as described above. Official Rules & Regulations
These are the Official Rules ("Rules") of digital-DNA Panels. By completing a survey, or registering for digital-DNA Panels, each entrant unconditionally accepts and agrees to comply with and abide by these Rules and with the decisions of digital-DNA (the "Sponsor"), whose decisions shall be final and binding in all respects.- NO PURCHASE NECESSARY TO ENTER OR WIN. VOID WHERE PROHIBITED BY LAW.
- How to Enter: Any person that registers with digital-DNA Panels will be automatically earn 500 points. In addition, each currently registered member of digital-DNA Panels that successfully completes and submits a digital-DNA online survey during is awarded additional points.
- Sponsor further reserves the right in its sole discretion to disqualify any entrant that tampers with the operation of the digital-DNA Panels website or violates the Rules.
- Eligibility: In order to participate in digital-DNA Panels, you must meet the following requirements:
- You must be a legal resident of the United States.
- You must be 18 years of age or older (or the age of majority in the state in which you reside, whichever is older) at the time of entry.
- You must be a registered member of digital-DNA Panels in good standing. To become a registered member of the digital-DNA Panels, you must first complete the registration survey. If the registration survey is submitted successfully over the internet, digital-DNA Panels will then send a confirmation email to the email address you have provided. This email will ask you to reply and confirm that you wish to join the membership of digital-DNA Panels. You will not become a registered member of the Panel until you have replied to this email. You can leave the panel at any time by clicking on the 'Unsubscribe' link in the footer of every email communication or by emailing admin@digital-DNA.us.com the subject line indicating 'Remove' or 'Unsubscribe'.
Employees of digital-DNA or its subsidiaries, and members of their households are not eligible to participate. Employees of agencies that provide advertising, promotion and fulfillment services to digital-DNA Panels, as well as affiliates and operators of affiliate websites are not eligible to participate. digital-DNA further reserves the right to remove an individual from the digital-DNA Panels for any violation of terms and conditions of participation on digital-DNA Panels, including, but not limited to, if digital-DNA has a reasonable suspicion that an individual has provided false or dishonest responses to a survey or meaningless responses on multiple surveys.
- Limits of Liability: Sponsor has no responsibility whatsoever for injuries, losses, or damages of any kind that result from acceptance, possession, or use of any prize. Sponsor assumes no liability for lost or misdirected entry forms, registration forms or survey submissions whether due to technical or computer malfunctions or otherwise. Sponsor assumes no liability for technical or computer malfunctions of any kind.
- Changes to Rules:These Rules are subject to change, if necessary, and any changes to the Rules will be posted on the Sponsor website and become effective immediately upon such posting. You may cancel your registration at any time if you do not agree to the changed Rules.
